Seed Complaint Arbitration
The 1998 North Carolina General Assembly revised the North Carolina Seed Law to update the process by which a North Carolina farmer, homeowner, or other individual can request arbitration by the North Carolina Seed Board when seed fail to perform as warranted by bag and seed analysis label claims. The Seed Board is comprised of five members: two from North Carolina State University, one representing the North Carolina Seedsmen's Association, one farmer not involved in seed production or sales, and one representative of the North Carolina Department of Agriculture and Consumer Services. Sections 106-277.30 through 106-277.34 of the Seed Law describe the duties and function of the Seed Board, its membership, and procedures which must be followed to file for arbitration. The Seed Law can be found at the following internet web site:

When a seed buyer believes that purchased seed have failed to perform as labeled or warranted, he or she must make a sworn complaint against the dealer from whom the seed were purchased. The following information sheet and forms describe the process and requirements for filing for a seed performance investigation by the Seed Board.
